Introduction

By using the website helpfulfolks.com (hereinafter "Platform"), visitors and users accept these Terms of Use. Web- und Softwaresolutions Grimm (hereinafter "Helpful Folks") reserves the right to change these Terms of Use and the content of the Platform at any time without prior notice. It is the user's responsibility to regularly check the current version of the Terms of Use.

(2) Without prior written permission from Helpful Folks, no rights to trademarks, logos or other intellectual property rights are granted to the user.

(3) The reproduction, distribution, modification or use of the content of this Platform for purposes other than personal, non-commercial use is only permitted with the prior written consent of Helpful Folks.

(5) Violations of these provisions will be prosecuted to the full extent permitted by law.

General Terms of Participation

(1) Users of the Platform agree to observe the content guidelines and to use the service only for its intended purpose.

(2) In particular, the following is prohibited:

  • distributing defamatory, offensive, objectionable or illegal content,
  • threatening, harassing or violating the rights of other users,
  • uploading virus-infected, harmful or copyrighted files,
  • using fake photos, images of cartoon characters, animals, landscapes or other non-personal images as profile pictures,
  • using images containing email addresses or internet addresses,
  • posting pornographic, racist or inciting content,
  • publishing personal contact details (names, addresses, phone numbers, email addresses) outside the designated fields,
  • using technical means such as scripts, bots or programs directed against the intended operation of the Platform,
  • unauthorised modification or deletion of content, data or results of the Platform,
  • circumventing the intended usage paths of the Platform or manipulating its functions.

(3) Violations of these Terms of Participation may result in immediate exclusion from the Platform as well as civil and criminal consequences.

Links to Other Websites

(1) The Platform may contain links to external third-party websites. Helpful Folks has no influence on the content of these websites and assumes no responsibility for their content or the consequences of their use.

(2) The use of linked external websites is at the user's own risk.

(3) Setting links to the Platform helpfulfolks.com requires the prior consent of Helpful Folks.

Limitation of Liability

(1) Helpful Folks endeavours to provide current and correct information on the Platform, but does not guarantee its accuracy, completeness or timeliness.

(2) Helpful Folks assumes no responsibility for user profiles, registration data or user-generated content and is not liable for their misuse.

(3) Contracts for services are concluded exclusively between the users involved (Service Seekers and Service Providers). Helpful Folks is neither a contracting party nor liable for the provision or quality of services agreed between users. All matters between Service Seekers and Service Providers, including service provision and payments, are to be settled directly between them.

(4) For damages arising from injury to life, body or health, Helpful Folks is only liable in the event of intentional or negligent breach of duty.

(5) For other damages, Helpful Folks is only liable for breach of material contractual obligations (cardinal obligations) or in the event of intentional or grossly negligent breach of duty. In the case of breach of material contractual obligations, liability is limited to the foreseeable, contract-typical damage.

(6) Helpful Folks is not liable for unauthorised access to personal user data by third parties, provided that Helpful Folks has taken reasonable technical and organisational protective measures. Likewise, Helpful Folks is not liable for the misuse of information that users themselves have made publicly available.

Platform Availability

(1) Helpful Folks aims for a platform availability of 97% on an annual average.

(2) The following are excluded from the calculation of availability:

  • scheduled maintenance work,
  • offline backups,
  • interruptions due to force majeure,
  • disruptions not attributable to Helpful Folks.

(3) A completely error-free provision of the Platform is technically not possible. Errors may lead to temporary restrictions or shutdowns. Availability also depends on factors beyond the control of Helpful Folks (e.g. transmission capacities, network connections).

Discussion Forums and Communication

Where the Platform provides communication features (chat, messages, reviews), users agree to treat each other with respect. The distribution of offensive, degrading, objectionable, defamatory or obscene content, as well as the infringement of third-party intellectual property rights, is prohibited.

Personal Data

The processing of personal data is carried out in accordance with our Privacy Policy. Users can request the deletion of their registration and personal data at any time via the account settings or by email to hello@agilunis.io.

Final Provisions

(1) Should individual provisions of these Terms of Use be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. An effective provision shall take the place of the invalid provision that comes closest to the economic purpose of the invalid provision.

(2) Complaints or reports of violations can be submitted by email to hello@agilunis.io.

(3) These Terms of Use have been drawn up in compliance with the provisions of the Federal Republic of Germany and are aimed at users domiciled or based in Germany.
